We Should Go Back To The Hammurabi Code For Our Laws.
Seriously that is such a better form of rules then anything we have. For example under our laws, people choose if someone dies and one doesn't. Lets say that in 2 different states, 2 people commit the same crime, and that is murder. In one they are put to death and in the other they get off scott free because the "chain of evidence" was broken or something wasn't done right and the evidence shows that they did it. How is that just?? Under hammurabi, if they killed someone they were killed. Just.

Although I understand your intent is "fairness" the truth is Hummurabi's Code is "an eye for an eye" and is inherently unfair. If a drunk driver kills your daughter then killing his daughter would be very unfair to her, or in fact he may not even have a daughter so how could you get justice? If a poor man steals food and eats it until he has none left then how can you steal the equivalent amount of food back from him. If a maniac brutally rapes a child then do you brutally rape the maniac - and is it quite the same thing?

Even if you take away the eye for an eye part and simply mean comparable severity of outcome must be achieved you ultimately can end up hurting family of the perpetrator instead of just the perpetrator directly. It just isn't as simple as an eye for an eye.
